I am having a problem and am not sure which direction to go in.

 

This involved USPS tracking # ********

 

We sold a silver bar on eBay approximately April 20, 2019 – The item shipped from our home to the buyer in Bethlehem, PA. The package was delivered; signed for by the buyer as required for anything insured over $500. The package was insured for $1600.00 by us.

 

The problem started when this buyer claimed he came home and there was an empty box in his mailbox and that he didn’t even sign for it. We filed a claim with USPS (referenced in subject line) and provided photos that the buyer sent us of the box. The package was held up in OKC for a few days then again in Lehigh PA USPS also before being delivered.

 

While the claim was already filed with USPS, we went to our local post office and had our local Postmaster General investigate the tracking number, gave her the photos he sent us (which looked like the box had been cut opened -it was not in bad condition due to mishandling; and had a yellow post it note applied stating the box was received empty at his local post office). Our Postmaster was told by her investigation (which she verbally relayed to us) that the reports from his local post office carrier was they his mail handler remembered delivery of the package and the comments made by the buyer at to the heavy weight of the small package (7 lbs., 1 oz) and that the Post Office would not have applied a post-it note on a package stating it was an empty box – when it shipped out just over 7 lbs. and being insured for so much and left it in his mailbox…

 

We first got a letter from the post office, saying that the buyer needed to mail the box back to us so we could take it to our post office to aid the investigation -there was a deadline on the getting the box to the post office and the buyer knew this – but he waited to mail it back to us. Once we provided the box in the same state as in the photos he sent us, and the post office had a signed (by him) POD…the investigation/Claim was closed by the USPS and the letter we received from the USPS was the claimed was denied due to lack of evidence to support the box was delivered empty and left in his mail box, as he claimed. Hy husband thought instantly, he didn’t have a good feeling and thought the buyer was trying to pull something over on us.

 

After about a week, the buyer filed a claim with eBay; which after their investigation and the supporting documents I provided them (POD), the case was closed in my favor, thankfully/rightfully.

 

THEN he filed a claim with PayPal stating he didn’t get the package, and again I provided and the photos of the box -and told them the full story from the eBay claim and the proof of delivery from the post office, they closed the claim/dispute in my favor also. THEN he appealed the case – changing his story stating the item was “not as described” – requesting refund, and PayPal sided with him within 1 day, and refunded him the money, without my knowledge or giving me an opportunity to counter – and they will not show me what documentation he provided that shifted them in his favor. I am getting the complete run around, and my PayPal account is now negative $1570 – and he has our money – and our 100oz silver bar.

 

I then went back USPS is; asking if I can file a complaint against this person who is trying (and succeeding) in mail fraud, and theft of property through the USPS system? And to PayPal requesting the support of USPS, who has proved delivery by no doubt, but I am still having to pay for this, and I don’t know where else to turn. Hopefully you can help me. The USPS opened another investigation, but my only call back was from the Post Office in Lehigh, PA left me a voicemail telling my I could file a claim online with the USPS.

 

What are my rights? PayPal is a company used in facilitating financial transactions between a buyer and a seller – they don’t have the authority to override an investigation when the sell happened on eBay and the claim was already processed through eBay. I have asked PayPal to return my money or the merchandise with to response. I have even sent email after email to their customer support via my outlook and on their internal messaging system, asking them to look at all the claims and see where this guy is guilty of mail fraud and felony theft. This is going to affect my credit, my seller status on eBay, not to mention the personal stress I am going through, not being heard while being taken for ($1570.00).

What would you like the company to do to fix the problem? (optional)
Total Refund to My account – and I would like to know if I can sue PayPal for punitive damages – and I want see about filing charges against the buyer.
